Update: Appeal court orders ASUU to honour industrial court judgment

An Abuja Court of Appeal has upheld the national industrial court judgment directing members of the Academic Staff Union of Universities (ASUU) to resume work immediately.

The presiding judge, Justice Hamma Akawu Barka, queried why ASUU had disobeyed the industrial court judgment which had directed the union to resume classes while awaiting judgment on the lawsuit filed by the federal government against the union.

He warned that if ASUU fails to comply with the court order, it automatically loses the right to appeal against the ruling of the industrial court.

The court struck out the application by ASUU for a stay of execution of the order of the Industrial Court, based on the motion by the applicant’s counsel, Femi Falana (SAN), for the withdrawal of the application.

Reading the lead ruling, Justice Hamma ordered ASUU to file its notice of appeal on the ruling of the lower court within seven days.
